Terms and Conditions
1. Provider and agreement
Your service provider is Elaina Mangano, trading as Solutions Mangano Studio, Via Tomaso Landi snc, 98158 Messina, Italy; info@mangano.studio. We serve businesses and private consumers. A written quotation identifies the service, deliverables, price, schedule and any specific conditions. An enquiry alone does not place an order. Work begins only after written agreement and any agreed advance payment, subject to the consumer provisions below.
2. Prices and payment
For one-off projects, 50% is payable before work starts and 50% after the agreed work is ready for review, before final files or reports are handed over, unless the written proposal expressly agrees otherwise. Monthly hosting and care are billed on the schedule stated in the proposal. Payment may be made by bank transfer, PayPal or cash where lawful and agreed. Payment instructions are provided directly; we never ask for account passwords.
Before acceptance, the quotation states the final amount payable, applicable taxes and agreed third-party costs. The invoice identifies the applicable tax treatment. An advance payment is part-payment, not an automatic non-refundable cancellation penalty.
3. Scope, content and delivery
The agreed package defines page counts, functionality, revision rounds and support. Additional work requires a separate agreement. You provide accurate content, approved legal text and materials you have permission to use. Delays in supplying content or approvals can affect the schedule; revised dates are communicated. Domain registration, external subscriptions and translation are included only where expressly agreed. We do not build e-commerce sites or provide email accounts.
You can review the agreed deliverables before final handover. Included revisions apply within the agreed scope. Rights to use our agreed final deliverables and file handover follow the written proposal and full payment, without affecting your rights in materials you supplied or mandatory consumer remedies. Third-party licences continue to apply. Report defects by email; included support does not replace statutory rights.
4. Cancellation and completed work
For QA and security assessments, we confirm the start date, time and time zone in writing. You may cancel by email up to one hour before that start time without a service cancellation charge. After that deadline or after work starts, there is no additional contractual change-of-mind cancellation right. This does not remove any statutory withdrawal, termination, defect or refund rights. Amounts payable for a lawful termination depend on work actually performed, agreed costs and applicable law; the full fee is not automatically forfeited.
A completed website is not refundable solely because you change your mind, except where a statutory right applies. If a website project ends before completion, the account is settled under the agreed scope and applicable law. Nothing in these terms treats custom website work as automatically exempt from consumer withdrawal rules.
5. Consumer withdrawal
For a service contract concluded at a distance, a consumer generally has 14 days from conclusion to withdraw without giving a reason. Mandatory extensions or special rules remain applicable. Notify us by a clear statement sent to info@mangano.studio or the postal address in the Legal Notice. You may use the model below, but it is not compulsory. Send the notice before the applicable deadline.
If you want work to start during this period, we must first obtain your express request in a durable record. If you then withdraw, a proportionate charge for services already supplied may apply only where the legal conditions are met. The withdrawal right is lost after full performance only with the legally required prior express consent and acknowledgement. Starting work or paying a deposit alone is not enough. Any applicable digital-content rules require their own valid consent and acknowledgement.
Where withdrawal requires a refund, it is made without undue delay and within 14 days of notice, using the same payment method unless you expressly agree otherwise without extra cost. Any lawful proportionate service charge is accounted for. Statutory remedies for non-performance or defects are unaffected.
Model withdrawal notice
To Elaina Mangano — Solutions Mangano Studio, Via Tomaso Landi snc, 98158 Messina, Italy, info@mangano.studio: I/We withdraw from the contract for the following service: [service]. Contract date: [date]. Consumer name(s): [name]. Consumer address: [address]. Date: [date]. Signature only if sent on paper: [signature].
6. Hosting and care subscriptions
Hosting and WEBSITE CARE can be terminated with one full month’s written notice by email. We confirm receipt and the final service date in writing. Service fees remain due through that date, subject to statutory withdrawal or other mandatory rights. Any prepaid amount covering time after the effective end date is returned. Your domain remains yours; domain registration and renewal are not included. No email accounts are supplied.
WEBSITE CARE includes up to 60 minutes of minor changes per month; unused time does not roll over. Hosting is separate. New pages, redesigns, new functionality, integrations, extensive troubleshooting and incident recovery are outside this allowance and require a quote. Hosting capacity, migration arrangements and any specific availability commitments are set out in the proposal; no uninterrupted-service guarantee is implied.
7. QA and authorised security work
Testing covers only the systems, methods and period agreed in writing. You must own the systems or have authority to permit testing, including any required third-party permission. Security services are scoped assessments, not full penetration tests or a guarantee that no vulnerabilities exist. QA is a time-limited sample of agreed functionality, not a guarantee of no defects. Included retests or verification checks follow the package and agreed scope. Sensitive findings are shared privately with the authorised client.
8. Confidentiality and client data
Both parties should protect confidential project information and use it only for the agreed work, except where disclosure is legally required. If we process personal data on your behalf, a suitable data-processing agreement and supplier arrangements must be established before access. This public privacy notice does not replace that agreement.
9. Complaints, liability and applicable law
Please send complaints and defect details to info@mangano.studio so we can investigate and discuss an appropriate remedy. These terms do not exclude liability for intentional misconduct, gross negligence or anything that cannot lawfully be limited. They do not restrict mandatory consumer rights or payment-provider dispute rights. Italian law applies without depriving consumers of mandatory protections applicable in their country of habitual residence. Consumer jurisdiction rules remain unaffected; no exclusive Messina court is imposed on consumers. Changes to published terms do not retrospectively change an agreed contract.
